Liability:  Renter agrees to indemnify, defend and hold harmless WFW Investments, LLC. against any and all claims, cost or liability damage or injury to any person or property during the event, caused by the negligence of the rental customer that does not result from the direct use of the rental items stated above.  WFW Investments rental equipment is labled for proper age and size limits.


Acts Beyond the control of Parties:  Renter and WFW Investments, LLC. acknowledge that this contract is not binding until excecuted by all parties, and thereafter, this contract is subject to performance by both renter and provider unless performance is impossible due to accidents, sickness, strikes, acts of God or other legitimate conditions beyond the control of the parties.  In case of poor weather conditions which permit the use of the unit, a rain check will be issued and the rental may be used on another date.  WFW Investments prohibits the use of equipment by any person under the influence of alcohol, drugs or any other "intoxicating" substance at any time.

Arbitration:  Any controversy or claim which arises cut of this contract, or the services of this contract, shall be governed by the Laws of the State of Minnesota and shall be resolved only in Stearns County, MN,  by arbitration in accordance with the rules of the American Arbitration Association with an arbitrator mutually agreed upon by the parties to the arbitration.  The Arbitrator's decision shall be final and binding upon both parties.
